Responsabilidade dos intervenientes sobre os vícios construtivos no sistema lumínico natural em edifício habitacional

Abstract

O desempenho e a qualidade satisfatória de uma edificação são quesitos que o consumidor atualmente não dispensa. Sabendo disso, a indústria da construção vem se aprimorando para suprir essa necessidade. Apesar disso o consumidor se depara em muitos casos com falhas em suas edificações que geram transtornos e depreciação do seu imóvel. Para a resolução desses problemas o usuário acaba tendo que acionar a justiça pois nem todas as empresas admitem sua responsabilidade, principalmente por se tratar de um tipo de bem que envolve vários intervenientes na sua concepção e manutenção. Esse trabalho buscou a aplicação da fundamentação teórica envolvendo leis, normas, artigos, entre outros que envolve as falhas no objeto de estudo, observando o uso da edificação e sua manutenção. Foi desenvolvida uma pesquisa descritiva inicialmente através de uma inspeção visual na edificação habitacional objeto de estudo. Buscou-se mapear as anomalias na edificação envolvendo o sistema lumínico natural com auxílio de registro fotográfico; dados colhidos foram confrontados com os conceitos estudados e parte da documentação da edificação disponibilizada pelo síndico além de registros pessoais da época do estágio em obra na edificação; assim foi possível verificar os vícios construtivos com teor relevante e delimitar a pesquisa focando no sistema lumínico natural que envolve o principal vício. Com o auxílio da ABNT NBR 15575, sob o título geral “Edificações habitacionais — Desempenho” também conhecida como “Norma de Desempenho” e outras normas prescritivas foi possível analisar o desempenho dessa edificação. Após análise das informações coletadas, foi constatado que a falta de desempenho lumínico natural está relacionada a elementos como o afastamento lateral e de fundos, a topografia da área do Edifício Habitacional, a topografia do entorno e a área de vegetação do entorno. No final dessa investigação foi possível determinar que existiu pelas partes elementos que caracterizam ação ou omissão voluntária, negligência ou imprudência, assim sendo possível determinar as responsabilidades de cada interveniente sobre os vícios construtivos no objeto de estudo. Sendo o dano constatado e o direito violado o proprietário/inquilino pode acionar a garantia do empreendimento ou também questionar o cumprimento da vida útil de projeto contemplada na NBR 15575. Ao final deste trabalho também foram discutidas algumas formas de melhorar o desempenho lumínico natural.

The performance and satisfactory quality of a building are requirements that the consumer does not dispense today. Knowing this, the construction industry is improving to meet this need. Despite this, in many cases, consumers are faced with flaws in their buildings that cause inconvenience and depreciation of their assets. To solve these problems, the user ends up going to court, because not all companies assume their responsibility, mainly because it is a type of activity that involves several participants in its creation and maintenance. This work sought to apply the theoretical basis involving laws, standards, articles, among others, that involve the flaws in the object of study, observing the use of the building and its maintenance. A descriptive research was developed initially through a visual inspection of the housing building under study. It was sought to map anomalies in the building involving the natural lighting system with the aid of photographic record.; the data collected were compared with the concepts studied and part of the building documentation provided by the union, in addition to the personal records from the time of the internship in works; thus, it was possible to verify the flaws with relevant content and delimit the research with a focus on the natural lighting system that involves the main constructive addiction. With the help of ABNT NBR 15575, under the general title "Residential Buildings - Performance", also known as "Performance standard" and other prescriptive standards, it was possible to analyze the performance of this building. After analyzing the information collected, it was found that the lack of natural lighting performance is related to elements such as side and bottom spacing, topography of the Housing Building area, topography of the surroundings and surrounding vegetation. At the end of this investigation, it was possible to determine that there were elements that characterized voluntary action or omission, negligence or imprudence, making it possible to determine the responsibilities of each participant in relation to the flaws in the object of study. Once the damage has been verified and the right has been violated, the owner / tenant can activate the project guarantee or also question the fulfillment of the project's useful life in NBR 15575. At the end of this work, some ways of improving natural lighting performance were also found. discussed.
